Terms of carriage
1. Acceptance
Goods are accepted for carriage on these conditions. Placing a booking, tendering goods for collection or signing a consignment note constitutes acceptance by the customer.
2. Quotations and rates
Rates are quoted on the information supplied by the customer. Where actual weight, cubic volume, dimensions or delivery conditions differ from those quoted, the rate may be adjusted to the applicable schedule.
3. The customer's obligations
- Goods must be packed adequately for the type of carriage booked.
- Dangerous, prohibited or temperature-sensitive goods must be declared in writing before collection.
- Safe access must be available at both the pickup and delivery points.
- The customer warrants it is entitled to tender the goods for carriage.
4. Delivery
Transit times are estimates given in good faith and are not guaranteed. Delivery is effected when the goods are tendered at the nominated address and a signature or photograph is obtained, or where authority to leave has been given in writing.
5. Subcontracting
We may subcontract all or part of the carriage. Every subcontracted operator engaged on our behalf works under our compliance and insurance arrangements.
6. Liability
To the extent permitted by law, and subject to any rights the customer has under the Australian Consumer Law which cannot be excluded, our liability for loss of or damage to goods is limited as set out in the rate schedule. Consequential loss is excluded.
7. Claims
Damage or shortage must be noted on the consignment note at the time of delivery and confirmed in writing within seven days. Claims for non-delivery must be lodged within 21 days of the expected delivery date.
8. Payment
Invoices are due 30 days from the end of the month of invoice unless otherwise agreed in writing. We may exercise a lien over goods in our possession for unpaid charges.
9. Governing law
These conditions are governed by the laws of Victoria, Australia.
